Terms & Conditions of all Services
TRACKEN KENNELS TERMS & CONDITIONS
By booking, purchasing, enrolling in, or using services provided by Tracken Kennels (“Tracken”), the client acknowledges that they have reviewed and agree to the following Terms & Conditions. These terms apply together with any service-specific information provided at the time of booking.
1. Payment & BookingPayment is due as indicated at the time of booking. Training packages are payable in full upon booking unless otherwise agreed in writing.A booking is not considered secured until required payment has been received.Prices are subject to applicable GST.
2. Group Training Courses & Packages
Group training courses and packages are sold as complete programs rather than individual classes. Once a course or program has commenced, course and package fees are non-refundable, including where the client does not attend or complete some or all remaining classes. No refund or prorated refund will ordinarily be provided for missed, unused or incomplete classes resulting from scheduling conflicts, personal circumstances, relocation, changes in the client's availability, changes in a dog's health or behaviour, veterinary restrictions, or other circumstances outside Tracken's control. Where circumstances warrant, Tracken may, at its sole discretion, offer an alternative such as a credit, transfer, modified service, private session or partial refund. Any exception is a goodwill accommodation and does not alter Tracken's policies or create an entitlement to the same accommodation in another circumstance.
3. Private Training
Private sessions require a minimum of 24 hours' notice for cancellation or rescheduling.A private session cancelled by the client with less than 24 hours' notice may be charged in full.Private-session packages must be used within 30 days, unless Tracken agrees otherwise in writing.Late arrival by the client may result in a shortened session without a reduction in price where another appointment follows
4. Boarding
Boarding reservations are subject to availability and any booking requirements communicated at the time of reservation. All dog(s) must be social with other dogs for boarding. Boarding checkout time is 10:00 a.m. Additional daily charges may apply after checkout time. There is no refund or credit for early pickup or unused reserved boarding days, except where Tracken expressly agrees otherwise. Clients must provide complete and accurate information concerning their dog's health, medications, feeding requirements, behaviour and any history of aggression, reactivity, escape behaviour or other safety concerns upon receiving the Boarding Waiver via email prior to start date. Tracken reserves the right to decline or discontinue boarding where reasonably necessary for the health or safety of the dog, other animals, staff or members of the public.
5. Board & Train / Behaviour Modification
Board-and-train and behaviour-modification services may be customized according to the individual dog and training objectives. These goals and objectives will be outlined in an information sheet provided to owner prior to start date for approval and understanding of goals. The client understands that behaviour and training progress varies between dogs and depends on numerous factors, including temperament, health, previous experiences, environment and owner consistency following the program. No particular behavioural result or training outcome is guaranteed. Continued owner participation and consistent reinforcement after the dog's return may be necessary to maintain progress.
6. Dog Health & Veterinary Conditions
Clients are responsible for advising Tracken before services begin and throughout the service period of any known or suspected medical condition, injury, allergy, medication, transmittable infections, veterinary restriction or significant change in their dog's health. If a dog's health or physical ability changes after enrollment, Tracken will determine whether the booked service can reasonably and safely be modified or continued within the scope of services Tracken provides. A medical diagnosis or change in health does not automatically create an entitlement to a refund for services already provided, reserved or commenced. Tracken may request veterinary documentation when a client requests an accommodation, credit, transfer or refund based upon a dog's medical condition. Tracken Kennels does not provide veterinary advice or veterinary medical treatment. Clients should consult a licensed veterinarian regarding medical diagnosis, treatment and medical restrictions.
7. Behaviour & Safety Disclosure
Clients must disclose any known history of:
•biting or attempted biting;
•aggression toward people or animals; •significant reactivity;
•resource guarding;
•escape behaviour;
•severe anxiety or fear behaviours; or
•other behaviour that could reasonably affect the safety of the dog, trainer, staff, other animals or members of the public.
Failure to disclose relevant behavioural information may result in modification or termination of services where Tracken determines it is reasonably necessary for safety.Additional or specialized services may be recommended where a dog's needs fall outside the originally booked program.
8. Training Results
Dog training is a collaborative process involving the trainer, dog and owner.Tracken will provide services using its professional experience and judgment; however, results cannot be guaranteed.Results may be affected by factors outside Tracken's control, including the dog's temperament, health, age, history and environment, as well as the owner's consistency, participation and continued implementation of training.
9. Missed Classes, No-Shows & Client Availability
A client's inability to attend a scheduled class or session does not constitute cancellation by Tracken.Missed group classes are not refundable.Make-up classes, transfers, credits or alternate arrangements may be offered when reasonably available but are not guaranteed unless Tracken has agreed to them in writing.In group classes in the case of an ill or injured dog, the owner/handler can still attend class to learn the skill taught for that week to take back home to practice or request in writing to the trainer that you would like an update on what was learned during that session
10. Cancellation by Tracken Kennels
Tracken may reschedule or cancel a class, session or service due to weather, illness, facility issues, safety concerns, insufficient enrollment or other circumstances reasonably affecting Tracken's ability to provide the service.Where Tracken cancels a service that cannot reasonably be rescheduled or provided, an appropriate credit, transfer or refund for the unprovided portion of the service will be offered, subject to applicable law.
11. Seminars, Workshops, Drop-Ins & Evaluations
Registration fees and cancellation requirements for seminars, workshops, drop-in sessions, evaluations and special events may vary by event.Any event-specific terms communicated before purchase form part of these Terms & Conditions.1
12. Photographs & Social Media Photo/Video Consent:
I authorize Tracken Kennels to photograph or record my dog during services and to use those images or recordings for educational, promotional, website and social-media purposes. I understand that declining consent will not affect my dog's eligibility for services.That is cleaner than burying consent in the fine print.
13. Communications
Clients are responsible for providing accurate contact information and monitoring communications concerning their booking.Any modification to these Terms or a client's booking must be confirmed by Tracken in writing to be effective.
14. Limitation of These Terms
Nothing in these Terms & Conditions is intended to exclude, restrict or waive any consumer right, remedy or protection that cannot legally be excluded or waived under applicable Court of Law in Alberta.If any provision of these Terms conflicts with a mandatory requirement of applicable law, that legal requirement will prevail and the remaining provisions will continue to apply to the extent permitted by law.
